How To Get A Copy of Divorce Decree

After you have made it through your family law case, you need to obtain a copy of the Final Order. This applies for cases such as divorce, child support modification, child custody and enforcement.  The Final Order outlines all that is expected of you and your spouse now that the case is done and over with. You are bound by the terms and conditions of that document unless a court issues another order. You can face litigation in a court if you do not stick to those terms.

What To Do To Get A Final Order

You can take either of the following steps to order a Final Order if your case was heard in Harris County:

  • You can order the paperwork from the Family District Clerk   located at 201 Caroline Street
  • You can purchase copies of the final order online. Know that it costs $1.00 for every page of a certified copy of the Final Order.
  • You can request for certified and uncertified copies of your final order through mail. But to do this you will need to complete a form that is available at the District Clerks website. If the request is accepted, you will get a certified or non-certified copy via mail.

You can always ask your lawyer to help you create a post case plan that includes getting a copy of the Final Order.

Do you Need A certified Copy?

A certified copy is an actual and complete copy of the final order that was signed by the judge.  It also has a state embossed seal on each page. You will need this certified copy in the following situations:

  • When you need to legally change your name, you will need a certified copy that shows the judge allows you to do that
  • When you want to change the beneficiary of a life insurance policy you hold
  • When you want to remove a spouse from a bank account
  • When you want to inform a school about the possession schedules for your child to avoid any future problems
  • When you want to get remarried
  • For the distribution of a will

The seal on each page of a certified copy makes it official and believable. Order as many copies as many certified copies as possible so that you can always present them in different situations. You will need to provide the following information to get this certified copy:

  • Full names of both the wife and husband
  • The date of the divorce
  • The municipality where the divorce was granted
  • Reason for requesting a copy
  • What relationship you have to the divorced parties

Uncertified Copies

Uncertified copy cost only $.10 per page in Harris County, which about the same that you have to pay in other counties in Texas. You can utilize a non-certified copy to replace lost or misplaced divorce decrees. This is in situations where you have to prove that the divorce was finalized. A mailed request for a copy of the Final order can take weeks, but in-person request only a few days.
